Eagmark Online Learning Campus Affiliate Program Terms and Conditions

Agreement

By applying to and participating in the Eagmark Online Learning Campus Affiliate Program (“Program”), you (“Affiliate” or “you”) agree to be bound by these Terms and Conditions (“Terms”). Eagmark Online Learning Campus (“Eagmark”, “we”, or “us”) reserves the right to update or modify these Terms at any time, without prior notice. Please review these Terms regularly.

1. Program Overview

  • The Program allows approved Affiliates to promote Eagmark Online Learning Campus courses across their marketing platforms.
  • Affiliates earn commissions on successful course sales generated through their unique affiliate link.

2. Eligibility

  • Affiliates must be at least 18 years of age.
  • Affiliates must possess an active online presence (e.g., website, blog, social media, email list) with a reach in sectors relevant to agriculture, education, or professional development.
  • Eagmark reserves the right to reject any application at its sole discretion.

3. Application Process

  • Submit an application HERE
  • Include:
    • Name and contact information.
    • Description of marketing platforms.
    • Target audience overview.

4. Affiliate Responsibilities

  • Promotion: Actively promote Eagmark courses in ways that align with Eagmark’s brand image and target audience.
  • Disclosure: Clearly disclose your affiliation with Eagmark when promoting courses. Use #sponsored or #ad as appropriate.
  • Ethical Marketing: Comply with all applicable laws, regulations, and FTC guidelines. Avoid misleading, deceptive, or fraudulent practices
  • Approved Materials: Primarily use provided marketing materials (banners, ads, text), with the option of creating your own content if pre-approved by Eagmark.
  • Prohibited Activities:
    • Do not make false or exaggerated claims about Eagmark courses.
    • Do not use spam, unauthorized email marketing, or other intrusive techniques.
    • Do not impersonate Eagmark or misrepresent your relationship with the company.
    • Do not purchase or promote using Eagmark’s branded keywords in search engine marketing.

5. Commission Structure

  • Base: 15% commission per successful course sale.
  • Tiered: Earn increased commissions based on sales volume:
    • Tier 1 (5-10 sales/month): 20% commission
    • Tier 2 (11-20 sales/month): 25% commission
    • Tier 3 (20+ sales/month): 30% commission
  • Bonuses:
    • New Affiliate Bonus: One-time bonus upon reaching first 3 qualified sales within the initial 30 days.
    • Top Performer Bonus: Additional bonus to the top-selling affiliate each month.
  • Commission Calculation: Commissions are based on the course price, excluding taxes or discounts.
  • Cookie Duration: Affiliate links utilize a cookie duration of 30 days. Sales made within that period from initial click-through will attribute to the Affiliate.
  • Payment: Commissions are paid monthly via available and selected payment platforms. A minimum threshold of US$100 in earned commissions is required for payout.

6. Intellectual Property

  • Eagmark retains all ownership of its trademarks, logos, course materials, and other intellectual property.
  • Affiliates are granted a limited license to use Eagmark’s marketing materials strictly for Program-related promotional purposes.

7. Termination

  • By Either Party: This Agreement may be terminated by either party with 30 days’ written notice.
  • Immediate Termination: Eagmark reserves the right to immediately terminate the Agreement for any breach of these Terms, including but not limited to, unethical marketing or intellectual property violations.

8. Disclaimer and Limitation of Liability

  • Eagmark courses are provided “as is”. We make no warranties about course suitability, merchantability, or fitness for a particular purpose.
  • Eagmark is not liable for any damages incurred by Affiliates as a result of participating in the Program.

9. Indemnification

Affiliate agrees to indemnify and defend Eagmark from any claims or damages arising from the Affiliate’s breach of these Terms or their marketing activities.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya. Disputes shall be resolved first through good-faith negotiation. If unsuccessful, binding arbitration shall be used.
